Terms of Use

Version 2026-10-12.1 Updated: 12 October 2026

These Terms of Use govern access to and use of the RepClass application, website and related services.

By creating an account or using RepClass, you agree to these Terms of Use.

1. Operator and contact

RepClass is provided by Thiago Henrique da Cunha Mattos, Via Querce Petrarca SNC, 86092 Cantalupo nel Sannio (IS), Molise, Italy. Contact for support, complaints, cancellation, refunds, content reports and rights: contact@repclass.com. Include only necessary identifying information, never passwords or full card details. These Terms apply to adult representatives, family members and teachers. The Privacy Policy separately explains personal data. Accepting these Terms is not consent to advertising, optional tracking or other optional processing.

2. Platform availability

The RepClass web platform is already available: use it in a browser on a computer, tablet or smartphone, without installing an app. The iOS and Android apps are in preparation.

Creating an account or class and accepting an invitation does not authorise charges. A paid subscription requires express confirmation of the conditions shown before purchase. Data-protection obligations and authorisations required to enter and share content continue to apply.

3. Service and limitations

RepClass helps adults organise classes, lessons, calendars, announcements, documents, polls, trips and school-payment records, subject to available features and permissions. It is not a school, official school register, emergency service, childcare provider, transport organiser or financial-services provider. Urgent information, educational decisions and formal permissions must be confirmed through the proper channels. Read receipts, poll responses and participation confirmations do not replace signatures or parental or school authorisations required by law.

4. Adult accounts and security

Accounts are for people aged at least 18 with capacity to use the service. Provide accurate details, maintain your email, protect your password and do not share credentials. Registration does not confer authority over a school, family or child; anyone acting for others must be authorised. Report suspected unauthorised access. Verification must be proportionate and avoid excessive identity documents. Users' credential obligations do not remove the operator's own security duties.

5. Roles and permissions

The principal class representative manages invitations and available permissions, verifies members' entitlement, avoids public invitation codes and must not impersonate a school. Delegated rights should match necessary functions. Families join by invitation and provide only information they are entitled to provide. An in-app relationship does not resolve custody or parental-authority disputes.

Only the principal representative may invite a Teacher. The invitation has limited validity, is single-use and is bound to the recipient's confirmed email. Teachers may join multiple classes and publish lessons within granted permissions. The role does not provide general access to member lists, family information, school-payment records or administrative functions. Actual permissions do not expand merely because a user expects broader access.

The representative cannot edit a lesson published by a teacher. Teachers' personal notes, agenda and calendar are not automatically shared with the class; access follows those tools' permissions.

6. Invitations and product referrals

A discover-RepClass referral introduces the product and may identify a registration's source; it does not grant class membership. Family and Teacher invitations are separate mechanisms. Sharing through email, WhatsApp, SMS or another app is initiated by the user, who must check recipient and content. Spam, purchased contact lists and unlawful messages are prohibited. Receiving an invitation alone neither creates an account nor accepts these Terms.

7. Content, images and intellectual property

Uploaders must hold the necessary rights and legal basis and respect privacy, confidentiality, image rights and copyright. Identifiable images of children or adults require an appropriate basis for their particular purpose and audience. Permission for a school photograph is not permission for every subsequent disclosure.

Users retain their content rights and grant only a non-exclusive authorisation needed to store, technically reproduce and make content available to authorised recipients for the service. This does not authorise selling photographs, advertising reuse or training AI for the operator's own purposes without a separate lawful basis and notice. Retention follows the Privacy Policy. RepClass's software and branding remain protected, without excluding mandatory exceptions, including lawful interoperability rights.

8. Prohibited use

Fraud, harassment, unlawful discrimination, child exploitation, improper personal-data disclosure, copyright infringement, malware, unauthorised access, abusive vulnerability exploitation, improper extraction and interference are prohibited. Do not upload unnecessary identity documents, health, biometric, criminal-offence or other specially protected information. Do not use the app to surveil children, create commercial profiles of minors, expose locations or routines unsafely, or make legally significant decisions solely from informal records. Reports must be made in good faith.

9. Reporting and restrictions

Reports may be sent to section 1's contact with content location, an explanation, grounds for alleged illegality and a reply address, without unnecessary personal data. Contact competent authorities for immediate danger. RepClass may restrict content, revoke invitations or suspend features or accounts where needed for lawfulness or security. Measures must be proportionate to seriousness, risk and recurrence. Reasons and an opportunity to clarify will be provided where appropriate and lawful; investigations, law or protection of people may limit disclosure.

No advance review of every publication is promised. Absence of general monitoring does not remove duties arising from relevant knowledge or lawful cooperation requests. The Digital Services Act applies according to the service's actual classification and size; private class groups are not a general exemption.

10. School payments and trips

School expenses are user-entered organisational records. RepClass does not receive, hold or transfer these amounts between families, schools, representatives or suppliers. Actual organisers and recipients remain responsible under law for amounts, receipts, collections and refunds. These amounts differ from a RepClass subscription; a payment mark alone is neither a tax receipt nor bank confirmation. Competent organisers remain responsible for trip arrangements and safety, without excluding RepClass's responsibility for its own conduct.

11. Free trial

RepClass offers a 30-day free trial per class. Afterwards, plans cost €4.90 per month or €29.90 per year, per class, paid by the contracting representative and covering authorised members. Families and teachers are not charged individually merely for participating. The trial is granted once per class and does not restart following a change of name or representative.

Trial dates will appear in the class plan. Creating an account, accepting an invitation or reaching the end of the trial does not, by itself, authorise a charge. A paid purchase requires express confirmation of the offered terms. The trial does not replace mandatory withdrawal, refund, access or erasure rights.

12. Prices and purchase

RepClass plans cost €4.90 per month or €29.90 per year per class. One subscription paid by the contracting representative covers authorised members. Families and teachers do not purchase individual subscriptions to participate. The annual plan is not twelve monthly charges.

Before sales begin, the offer must specify total price, taxes, covered period, start date, payment method, required fiscal identification, renewal and cancellation. A paying order requires express confirmation and a confirmation the customer can keep. Testing will not be charged retroactively. Price changes do not alter already-paid periods. Another class does not automatically authorise another subscription.

13. Renewal and plan changes

Renewal conditions, dates, amounts and cancellation methods are presented before confirming a subscription. Creating an account or class alone never authorises charges. These Terms create no implied recurring-charge authority. If offered and knowingly contracted, cancelling renewal stops future charges under the confirmed conditions while preserving the paid period, except for withdrawal, termination, refund or another lawful reason.

Monthly/annual changes, prorating and replacement of the contracting representative require prior disclosure. Assignment of a contract, card or debt is not presumed. Account deletion or class archiving must not be represented as subscription cancellation unless it actually cancels the billing arrangement. Mandatory protections take precedence.

14. Consumer withdrawal

For covered distance service contracts, the ordinary withdrawal period is 14 days from concluding the service contract. The free trial is a separate commercial benefit. The contractual structure of trial and purchase must be clear; a fresh statutory period is not presumed at every renewal. An unequivocal declaration to section 1's contact is sufficient, with or without the model below.

Where an online withdrawal function is legally required, it must be available. Italian Consumer Code article 54-bis takes effect from 19 June 2026; sales must not start without the required mechanisms. A proportionate payment for service started during the withdrawal period is due only where legal conditions, including information and an express request, are met. Login, accepting Terms or initial use is not a blanket waiver. Exceptions for fully performed services or non-tangible digital content require their specific conditions and do not automatically cover an ongoing subscription.

15. Refunds and incorrect charges

Following valid withdrawal, amounts due back are generally reimbursed within 14 days after notice, through the original payment method unless a lawful express alternative is agreed without consumer fees. Proportionate deductions require a legal basis. Missing mandatory information may extend withdrawal rights. Report duplicate, unauthorised or contractless charges for correction, without prejudice to rights against a payment provider.

No additional commercial convenience-refund guarantee beyond statutory rights exists in the service. Rights for defects, detrimental modifications and improper charges remain. For app-store purchases, seller and procedure must be identified; store rules do not remove mandatory rights or RepClass's own obligations. Support is not conditional on waiving legal rights.

16. Conformity, updates and availability

Digital services must meet applicable contractual and legal conformity requirements. Remedies may include free correction, proportionate price reduction or termination with reimbursement under the statutory conditions. Necessary updates, including security updates, and significant changes must comply with legal notice and supply duties.

Uninterrupted operation, universal device compatibility and immediate notification delivery are not promised. Internet, device settings, third-party services and maintenance may affect use. These practical limitations do not remove legally required quality, security or remedies attributable to the operator. Do not use RepClass as your only archive.

17. Third parties and responsibility

Users are responsible for their own unlawful content, invitations and conduct where legal requirements for liability are met. Schools and participants do not become RepClass's agents merely by using it; RepClass does not automatically endorse every publication. The operator does not assume educational results, external payments, trips or matters exclusively attributable to third parties outside its obligations. Causation and each party's responsibility follow the law. Users do not give unlimited indemnities or assume the operator's own operational risks.

Nothing excludes liability for intentional misconduct, gross negligence, public-policy duties, non-excludable personal injury or personal-data violations, or any other mandatory responsibility. Suppliers selected by the operator and people for whom it is legally responsible are not automatically exempted. Italian Civil Code article 1229 and unfair-terms protections prevail.

18. Closure and shared content

Users may request account deletion and exercise privacy rights. Shared management may require a handover but cannot indefinitely prevent rights. Contact the operator if the app cannot complete a request. Shared content may remain without an author identifier, but text, images and attachments are not necessarily anonymous. Requests are assessed against the data involved, purpose, other people's rights and lawful retention requirements.

Class data and files will be deleted 30 days after a cancellation request accompanied by a request to delete the class, or 30 days after the subscription ends automatically. Cancelling only renewal, without requesting deletion of the class, does not start this request-based period.

When moving to a new school year, data and files from the previous year will be deleted 30 days after the move. Registration records and content for the new year will be preserved. This rule covers class content and its attachments stored in the service; it does not, by itself, delete participants' accounts or teachers' private tools.

19. Versions and acceptance

Documents have a version and date. Material changes will be communicated and, when required, separately accepted before relevant contractual effects. Old receipts will not be manufactured into new acceptance. Publication alone authorises neither charges, new data purposes nor waivers. Documents are free to read and download. Acceptance records version, document language and server time; later language changes do not alter that record. Mandatory rights prevail across translations, and ambiguous consumer terms are not automatically interpreted against the consumer.

20. Governing law and complaints

Italian law applies without depriving consumers of applicable mandatory protection in their habitual-residence country. Jurisdiction follows European and national consumer rules; no harmful distant exclusive forum or compulsory arbitration is imposed. Internal support is not a prerequisite to authorities or courts. Alternative dispute resolution follows applicable rules and competent entities, to be identified when required. The EU ODR platform closed on 20 July 2025 and is not an available complaint channel.

21. Optional withdrawal form

To the operator at section 1's address or email: I withdraw from my RepClass subscription contract. Contracting name: ______. Account email: ______. Class or order reference: ______. Contract date: ______. Notice date: ______. Signature only for paper notices. This form is optional; another unequivocal statement may be used. Do not provide full payment-card details.

22. Legislation explained

GDPR, Regulation 2016/679, covers lawful data processing, transparency, rights, security and accountability; suppliers do not remove controller duties. Directives 2011/83/EU and 2023/2673 address pre-contract information, distance contracts and withdrawal, including an online function. Directive 2019/770 covers digital-service conformity and remedies. Directive 93/13/EEC protects against unfair and unclear standard terms. Directives operate through national implementation; regulations apply directly within their scope.

Italy's D.Lgs. 206/2005 implements consumer safeguards, particularly articles 33-38, 49-59, 66-bis and 135-octies onward. D.Lgs. 212/2025 introduces online withdrawal under article 54-bis. D.Lgs. 70/2003 requires provider identification and electronic-contract information. Civil Code article 1229 limits liability exclusions. Regulation 2022/2065 (DSA) establishes graduated intermediary duties and conditional third-party-content liability protections. Rome I Regulation 593/2008 article 6 and Brussels I bis Regulation 1215/2012 articles 17-19 protect covered cross-border consumers. Directive 2013/11/EU concerns ADR; Regulation 2024/3228 closes ODR without removing other remedies. This is not an exhaustive list of mandatory laws.
